New Facet of Subsidiary in case of Civil Servants Involving in Lawsuit due to Public Function-with an emphasis on law amendment / Shi Huei-Fin

The change of the protection system for our civil servants triggered the review and amendment of the subsidiary regulations for civil servants involving in a lawsuit due to public function. The latest amendment to the regulations, by matching up with the newly amended Protection Act, has explicitly provided for the basis of authorization and confirmation of performance of duty by law. Also, the provisions regarding the scope, handling approach, and time limit for an agency to provide the subsidiary are added, so is the provision for establishing the agency to be in charge. In addition, the standards for the amount of subsidiary in case of involvement in a lawsuit have been amended. We expect that, through the improvement of the systems, the subsidiary system for our civil servants involving in a lawsuit due to public function will come to be reasonable, fair and efficient. Further, the rights and interest of our civil servants can be protected and our civil servants will be encouraged to take responsibility so as to create a warm, humane, and efficient civil service protection system.
