Introduction of "Draft of Civil Service Administrative Neutrality Act" / Chiang Yin-shi

In view of the experience of advanced democratic nations, a country shall have mature party politics to make a party acquire its ruling power by way of election, make policy and laws, and bring forth the national reform and progress. Also, on the other hand, there must be sound and solid civil service system requiring civil servants to take a neutral and impartial stance, and faithfully implement policy and laws. Those two things are complemental each other, and will keep the country progressing and promise it a lasting prosperity and peace. The Examination Yuan is the highest organization in charge of our civil service system. In order to cope with the development of political circumstances, as well as considering that civil service is the focal strength to carry out the government policy, and a civil servant shall be kept off from abusive use of power and resources and exempt from being requested by a superior to act in a way contradictory to administrative neutrality, the Examination Yuan deems it necessary to have adequate regulations serve as the legal basis for the duty performance of civil servants. Also, such regulations will rid a civil servant of unnecessary interference and protect his/her rights. Therefore, after extensive collection of relevant regulations and practice regarding civil service administrative neutrality of the advanced countries, the Ministry of Civil Service has drawn up "Draft of Civil Service Administrative Neutrality Act" and submitted it for review to, and passed by, the 35th meeting of the 10th Examination Yuan Council. Such Draft will be submitted to the Legislative Yuan for review so as to complete the legislation process. This paper is primarily to introduce the purport of administrative neutrality, the courses of study and drawing up of the Draft of Civil Service Administrative Neutrality Act, and substantially introduce the contents of such Draft and the related provisions as well.
