Organizations and Functions

The head of Examination Yuan is the President, assisted by a Vice President, who presides over the Yuan Council Meeting (CM) which is joined by the other 19 Ministers without Portfolio. The President, the Vice President, and the other 19 Ministers are all nominated first by the President of the Republic of China. After winning the approval of the Legislative Yuan, they are specially appointed to a six-year term by the President. The Examination Yuan also has a secretary-general and a deputy secretary-general. All policies and related issues are deliberated and resolutions are made at Examination Yuan Council Meeting. Under the Examination Yuan are two Ministries: the Ministry of Examination administers national examinations for civil servants and professional and technical personnel, and the Ministry of Civil Service is responsible for the qualification screening, survivor relief, and retirement of civil servants, as well as handling legal matters concerning their employment and discharge, performance evaluation, pay grading, promotion and transfer, and commendation and award. In addition, the Ministry of Civil Service oversees the operation of the Public Service Pension Fund Management Board (PSPFMB) and the Public Servant and Teacher Insurance Supervisory Committee, of both of which the Minister also acts as the chairman. The Civil Service Protection and Training Commission (CSPTC) is in charge of policies and legal matters for the protection of civil servants' rights and interests, training and continuing education of civil servants, as well as providing mid- and long-term senior civil service training, and offering courses to personnel who have newly passed the civil service examinations, rank promotion and administrative neutrality. The National Academy of Civil Service (NACS) is part of CSPTC and the Minister of the CSPTC also acts as the president of the NACS. The Central Taiwan Training Center was later established. The Public Service Pension Fund Supervisory Board (PSPFSB) is in charge of review, oversight, and evaluation of the civil service pension fund. The post of chairperson of the Supervisory Board is concurrently taken by the Vice President of the Examination Yuan. According to the Organization Act of the Directorate-General of Personnel Administration under the Executive Yuan, the Examination Yuan exercises oversight of its management of recruitment and civil service affairs.

The twelfth Examination Yuan President, Vice President and Ministers without Portfolio were inaugurated on September 1, 2014. 1. Examination Yuan Council Council

The Examination Yuan Council Meeting (CM) consists of the President, Vice President, Ministers without Portfolio, the Ministers of Examination, Civil Service, and Civil Service Protection and Training Commission (CSPTC). Meetings are chaired by the President or by the Vice President when the President is absent. When the President and the Vice President both are not available, one member of CM present is selected to act as chairperson. CM is held weekly, with provisional meetings convened when necessary, to audit all reports of civil service examinations and personnel administration policies and make decisions on major issues.

A final decision-making body, CM is convened with a quorum of more than half of the members. Resolutions are made by majority decision, and the chairperson of the session is empowered to cast the decisive vote in case of a tie. However, traditionally CM resolutions are reached by consensus. In addition to those required to attend CM, the Examination Yuan's Secretary-General, Deputy Secretary-General, the Deputy Ministers of the subordinate ministries, and the Minister of the Directorate-General of Personnel Administration, Executive Yuan, shall also attend. When necessary, the Examination Yuan President may appoint specific officials to attend CM, such as the Examination Yuan's first counselor, the director of the secretariat, and division directors of all operation divisions.

Depending on the nature of the motion under discussion, the Council may refer it for review by subcommittees or by the Examination Yuan Council Review Committee. The Examination Yuan Council Review Committee is composed of the Vice President, the Ministers without Portfolio, the Ministers of Examination, Civil Service, and Civil Service Protection and Training Commission. It is convened by the Vice President, except under extraordinary circumstances, in which case members may convene a session. Subcommittee review sessions consist of 7 to 11 members. Conveners and review committee members are assigned on a rotating basis. When motions are delegated for review, attendees shall be specifically named. Further, concerned units of the Examination Yuan and related departments are required to prepare briefing materials when necessary. When deemed necessary by the review session convener, other concerned personnel may be invited to participate. Following deliberation by the above-mentioned committees, the conveners are responsible for submitting a formal review report to the Examination Yuan Council.

The Ministers without Portfolio take a proactive approach to researching and planning related affairs under their purview. They conduct fact-finding missions to study the civil service systems in other countries for the reference of the CM in planning and improving the examination and civil service systems. They also visit various government agencies to better address examination and civil service issues at different levels. Gathering the voices of grass-roots civil servants and opinions from various sectors of society and engaging in close communication with local agencies, they provide a close-up view of the situations and make it more feasible to scrutinize and implement examination and civil service policies.

2. Examination Yuan

The Secretary-General and Deputy Secretary-General of the Examination Yuan assist the President in carrying out daily operations. In the Examination Yuan there are 14 offices and departments. Each unit executes its respective duty and is responsible for reviewing examination and civil service administration policies, laws and statutes, and other administrative support. For example, the First Division is responsible for researching and planning policy guidelines, platforms, examination and issuing certificates to those who have passed civil service examinations; the Second Division is in charge of mapping out personnel policies and organic laws for various government units and routine administrative work such as employment and discharge, performance evaluation, pay grading, promotion and transfer, commendation and award, insurance, retirement and survivor relief, and other interests of civil servants; the Third Division is in charge of screening policy proposals for protecting and training civil servants and managing civil service pension fund. The various constituent units of the Examination Yuan actively work to strengthen policy-making functions as prescribed by law to ensure the quality of decision-making and administrative efficiency.

3. Ministry of Examination

The Ministry of Examination is headed by its Minister, who oversees ministerial affairs. A Political Deputy Minister and an Administrative Deputy Minister assist the Minister. Internal operations are divided into six departments, respectively responsible for Examination Planning, Senior and Junior Examinations, Special Examinations, Professional and Technical Examinations, Question Bank Management, and Information Management. There are six other auxiliary units, including the Department of General Affairs, Secretariat, Personnel Office, Accounting Office, Statistics Office and Civil Service Ethics Office.

The Ministry of Examination is responsible for holding two major categories of national exams – for qualifying civil servants and licensing professional and technical personnel. Depending on the requirements from various government agencies and the demands for licensed technical personnel, the Ministry holds about 20 examinations annually for over 800 categories of qualifications and professions.

To reach the goal of selecting qualified civil servants, the Ministry regularly holds 10 exams a year to select some 8,000 elementary, junior and senior civil servants as well as to select some 10,000 civil servants through special examinations for employment by the central and local governments.

4. Ministry of Civil Service

The Ministry of Civil Service is led by a Minister, a Political Deputy Minister and an Administrative Deputy Minister. The above-mentioned three officials jointly handle ministry affairs. Internal operations are divided among several departments, including the Department of Personnel Planning and Regulations, the Department of General Qualification Screening, the Department of Special Qualification Screening, the Department of Retirement and Survivor Relief, and the Department of Personnel Management. In addition, the Ministry of Civil Service oversees the operation of the Public Service Pension Fund Management Board and the Public Servant and Teachers Insurance Supervisory Committee, the minister of the Ministry of Civil Service also serves as the chairperson to manage the public fund and insurance.

The Ministry of Civil Service is responsible for a wide range of civil service administrative work, such as the employment and discharge of public servants, performance evaluation, pay grading, promotion, insurance, retirement pensions, and pecuniary aid in case of death. It also manages human resources departments in all government agencies. In order to meet the demands of the time, the Ministry of Civil Service has actively sought to review and improve the legal institutions as well as the compensation system for civil servants. On one hand, the Ministry has proposed draft amendments of the Civil Servant and Teacher Insurance Act, the Civil Service Promotion and Transfer Act, and the Civil Service Pay Act. On the other hand, in support of the government's pension reform program, the Ministry has also proposed amendments of the Civil Servant Retirement, Severance and Pecuniary Aid Act and the Political Appointee Retirement Pension Provisions Act. It will continue to work on the revision of the Civil Service Standards Act, the Political Appointee Act, the Political Appointee Remuneration Statute, the Civil Service Employment Act and the Civil Service Performance Evaluation Act as part of efforts to build a sound, practical, forward-looking and sustainable human resources management system which will ensure that all members of the civil service will have nothing to worry about as they devote themselves whole-heartedly to doing their jobs well, thereby helping to enhance government efficiency and ensure a lasting advantage in overall national competitiveness.

5. Civil Service Protection and Training Commission

In order to keep abreast with the world trends and social expectations, the Examination Yuan revised its organic law in 1994 and established the Civil Service Protection and Training Commission (CSPTC) on June 1, 1996. The main duty of the CSPTC is to protect and train civil servants.

According to the Organic Act, the Commission is headed by one minister, two vice ministers, and 10 to 14 commissioners. Within it, 5 to 7 full-time commissioners are appointed by the President of the Republic upon the nomination of the Examination Yuan President. Meanwhile, 5 to 7 part-time commissioners are appointed by the President of the Examination Yuan. All commissioners are assigned to a three-year term of office, which is renewable.

The Civil Service Protection and Training Commission has two missions. First, in terms of protecting civil servants, the Commission is obliged to institute a comprehensive set of laws based on which it shall fairly screen cases of dispute involving public servants and work to protect their rights and interests as well as to maintain the dignity of public servants in their execution of official duties. Second, in terms of training public servants, the Commission shall build a sound system for training and upgrading public servants' professional abilities by integrating all job-training resources available across the country. It is hoped that through such efforts, the country's public servants will boost their job performance and enrich public service human capital. Furthermore, the National Civil Service Institute was set up on July 26, 1999, which was upgraded and renamed as the National Academy of Civil Service on March 26, 2010 to meet the needs of national development in keeping with global trends. A training center was later set up in central Taiwan.

6. Public Service Pension Fund Supervisory Board

At first, the budget for public functionary retirement pension and compensation for death, disease and injury was fully paid by the government. However, due to rising civil servant pay levels, an increasingly longer average life span, and the growing number of retirees and compensation beneficiaries, it has become more and more difficult for the government to meet the budget demand. To address the considerable budgetary burden on the government, the Examination Yuan made amendments to civil service pension and compensation laws. Upon completion of legislation by the Legislative Yuan, starting in July 1995, the system has required joint contribution by the government and public servants. On May 1,1995, the Public Service Pension Fund Supervisory Board and the Public Service Pension Fund Management Board were set up to implement the system.

The Supervisory Board is responsible for the pension fund's review, supervision and appraisal of revenue, and supervision of pension fund management and operation. The board is comprised of 13 members representing various government agencies, namely the secretaries-general of the Executive Yuan, and Examination Yuan, as well as the chiefs of the Ministry of Civil Service and other government agencies, and 10 representatives from the military, public agencies and educational institutions. In addition to the Chairperson, a post concurrently taken by the Examination Yuan vice president, an executive secretary is in charge of routine work. The Supervisory Board consists of two departments -- the Department of General Affairs and the Department of Auditing. The Chairperson of the Public Service Pension Fund Supervisory Board is empowered to enlist 5 to 7 legal and financial experts as counselors to supervise the board's operation, and may convene an advisory review session at any time.

7. Directorate-General of Personnel Administration, Executive Yuan

The former Central Personnel Administration (CPA) was established according to Article 5 of the Temporary Provisions of the Constitution. Upon the abolition of those provisions, the legal organizational structure was completed according to the Amendment Articles of the Constitution, making the CPA a constitutional body. The CPA Organizational Statute was promulgated on December 30, 1993, In line with the organizational reengineering of the Executive Yuan, CPA was transformed into Directorate-General of Personnel Administration on Feb. 6, 2012. According to Article 1 of the Organization Act of the Directorate-General of Personnel Administration, Executive Yuan, “The Executive Yuan shall establish a Directorate-General of Personnel Administration (hereafter referred to as the Directorate-General) under its purview to formulate policies and carry out and develop personnel administration. Item 2 of the same article states that "The functions of the Directorate-General that pertain to the civil service examination and qualification reviews shall fall under the supervision of the Examination Yuan."

The DGPA is headed by a director-general and two deputy directors-general who are in charge of its operations and daily affairs. Subordinate units of the DGPA include the Department of Planning, Department of Organization and Manpower, Department of Training and Employment, Department of Remuneration and Welfare and Department of Information Management. To fulfill the DGPA's duty of training and developing central and local government manpower, two DGPA subordinate units – Civil Service Development Institute and Regional Civil Service Development Institute – were combined into the Civil Service Development Institute on July 7, 2017.
